Terms and Conditions

CONDITIONS

Unless agreed upon in writing, no terms and conditions in any order placed with M&E Pump and Equipment Company, Inc. other than those stated herein shall be binding on M&E Pump and Equipment Company, Inc.

PRICING

All prices quoted herein are subject to the prices in effect at the time of shipment. All pricing is subject to change without notice. M&E Pump and Equipment Company, Inc. is not responsible for any typographical errors. Pricing may not include any additional inbound or outbound freight charges that may apply.

PAYMENT TERMS

Payment terms are Net 30 days unless otherwise specified in writing and approved by M&E Pump and Equipment Company, Inc. All orders are subject to credit approval, and payment must be made in US Dollars. All quotations are for immediate acceptance of pricing. Pricing will be valid for 30 days from the issuing date of the quotation, unless otherwise specified in writing. Past due balances are subject to a finance charge (Periodic rate 1.5 % per month, 18% annually). Payments made via credit card are subject to a 3% surcharge applied to the total invoice amount.

SHIPPING TERMS

Acceptance of the material from a common carrier constitutes a waiver of any claim against M&E Pump and Equipment Company, Inc. for any delay or damages in transit. Shipment quoted is effective as of the quotation date and will be confirmed upon receipt of order. Shipment will be subject to availability of materials and/or the manufacturer’s proposed shipping date. M&E Pump and Equipment Company, Inc. shall not be held responsible for delays due to causes beyond M&E Pump and Equipment Company, Inc.’s control such as strikes, riots, carrier delays, etc. All freight charges including inbound and outbound freight are billed to purchaser. All merchandise becomes the property of the Purchaser upon delivery to the carrier. Delivery terms are F.O.B. shipping point, unless otherwise noted. Unless specific shipping instructions are given, we will use our judgment to determine the most satisfactory routing. M&E Pump and
Equipment Company, Inc. will strive to accommodate customers’ requested method of shipment, but cannot guarantee that the customers’ method of shipment can or will be honored. In the event a package becomes lost or damaged in shipment, please make appropriate notations on your delivery receipt before signing. If the carrier is a truck line, obtain an inspection report immediately. Contact M&E Pump and Equipment Company, Inc. for additional information.

TAXES

The Purchaser shall pay to M&E Pump and Equipment Company, Inc., in addition to the purchase price, the amount of all Sales, Use, Privilege, Occupation, Excise or other taxes, Federal, State, local or foreign, which M&E Pump and Equipment Company, Inc. is required to pay in connection with furnishing goods or services to the Purchaser.

WARRANTY

All standard manufacturer’s warranty applies. M&E Pump and Equipment Company, Inc. makes no warranty of any kind, expressed or implied. All transactions are an “As Is” Sale. No agent, employee, or representative of M&E Pump and Equipment Company, Inc. has the authority to bind M&E Pump and Equipment Company, Inc. to any affirmation, representation, or warranty concerning the goods that are sold by M&E Pump and Equipment Company, Inc. beyond that which is specifically included in writing from the manufacturer.

LIABILITY

M&E Pump and Equipment Company, Inc. shall not be held responsible for any failures of purchased items and/or damage to property, injury, or death resulting from the operation of equipment purchased from M&E Pump and Equipment Company, Inc. It is the responsibility of the purchaser to ensure any equipment purchased from M&E Pump and Equipment Company, Inc. is applied properly and operated safely in accordance with the manufacture’s guidelines. M&E Pump and Equipment Company, Inc. shall not be responsible for exemplary consequential, special, indirect compensatory or consequential damages. Additionally, the maximum liability for claims will not exceed the purchase price paid to M&E Pump and Equipment Company, Inc.

OTHER

All orders are subject to a $50.00 minimum. All returned items are subject the manufacturer’s guidelines for returning items. Upon acceptance by the manufacturer of the returned item(s), the order is subject to a 25% restocking charge. No refund or credit will be given for any freight charges that were incurred. All returns must be authorized prior to shipment back to M&E Pump and Equipment.

All industrial products must be flushed of any chemical (ref. OSHA Section 1910.1200 (d)(e)(f)(g)(h)) and hazardous chemicals must be labeled/tagged before being shipped* to SHURFLO for service or warranty consideration. SHURFLO reserves the right to request a Material Safety Data Sheet from the returnee for any product it deems necessary. SHURFLO reserves the right to “disposition as scrap” products returned which contain unknown fluids. SHURFLO reserves the right to charge the returnee for any and all costs incurred for chemical testing, and proper disposal of components containing unknown fluids. SHURFLO requeires this in order to protect the environment and personnel from the hazards of handling unknown fluids.
